Welly Ball 2022: Terms & Conditions for Raffle Ticket Holders

 

Please read these Terms and Conditions carefully and ensure that you understand them. These Terms and Conditions apply to Raffle Ticket Holders only.

Effective date: 26th October 2022

 

For reference, the following definitions apply to these Terms & Conditions:

Raffle - A service provided by Management known as “welly raffle 2022”.

Raffle Entry - A raffle ticket holder's individual submission into the Raffle.

Item – an item in the Raffle for which tickets are sold uniquely to received.

Raffle Ticket Holder - Including but not limited to any person who has entered into the Ballot. Successful Raffle Ticket Holders are known as "Winners".

Contractors - Including but not limited to any persons paid by Management to provide a service at the Event.

Event - the event named "welly ball 2022", which is due to take place on the 5th November 2022 and primarily organised by the Welly Ball Committee.

Management ("We"/"Us"/"Our") - Including but not limited to the Welly Ball Committee, Security, Law Enforcement, Medical Personnel, Vendors, Transport Personnel and owners/management team of the Venue.

Transport - A service paid for by the Management and operated by an external company, covered under Contractors.

Ticket Provider - FIXR ticketing platform. The FIXR mobile application and website (fixr.co) are owned and operated by VIPR Digital Limited trading as "FIXR". VIPR Digital Limited is a private limited company, registered in England (company number: 8184813, registered office: 35 Catherine Place, London SW1E 6DY).

Ticket Holder - Including but not limited to any person who has brought or obtained a ticket(s) to the Event under their legal name on the Ticket Provider's platform or otherwise with the intention of entering the Venue.

Venue - The site of the Event, Falside Mill. Including but not limited to all structures, both permanent and temporary.

By purchasing and/or being a holder of a Raffle Ticket(s) to the Raffle, you agree to the following Terms & Conditions where applicable. In addition, all subsequent Winners agree to the following Terms & Conditions where applicable. All Raffle Ticket Holders will have been made aware of these Terms & Conditions prior to purchasing/obtaining a Raffle Entry(s) or entering the Raffle respectively.

The following is referred to as the "Terms & Conditions":

1. Raffle for Raffle Ticket Holders

By entering the Raffle through purchasing of a raffle ticket, the Raffle Ticket Holder acknowledges that the outcome of the Raffle will be managed by the Management through fair and equal means. There will be one Winner per Item and all Winners will be contacted via email as provided by FIXR or at wristband collection. If the Winner is not contactable within 30 days of being first contacted following two follow up emails by Management, another Raffle Ticket Holder will be selected as the Winner and all previously uncontactable Winners will forfeit their right to receive the Item.

Physical Items will be required to be picked up in the Autumn from a St Andrews address. Items for the Event will be materialised during the main ticket release for the Event in the coming months. A Winner of an Item for the Event, will be considered as a Ticket Holder.

The time and length of the Raffle is at the full discretion of Management, however, it is assumed that each Item will be raffled off for 1 week.

2. Further Terms and Conditions applicable to Ticket Holders

Winners of Items for the Event are considered as Ticket Holders and are subject to any Terms & Conditions applicable to Ticket Holders of the Event.

2.1 Refund Policy for Winners and unsuccessful Raffle Ticket Holders

If the Event is rescheduled or cancelled, the Winners shall be entitled to be a Ticket Holder of the same rights and type to the Event when it is rescheduled.

All Raffle Entries are not subject to any refund, bear no cash value, and is not redeemable for cash. All Raffle Entries are not subject to exchange except as expressly provided above. All Raffle Entries obtained from sources other than the Ticket Provider may be counterfeit and worthless.

2.2 Force Majeure for Ticket Holders

In the circumstance where an act(s) of God (including but not limited to fires, explosions, earthquakes, drought, tidal waves, extremely high winds, floods, infectious disease and radioactive contamination) or any other external detrimental event that is outside the control of Management is about to occurred, continues to occur, or has occurred at the date, time and location of the Event that results in the cancellation of the Event, Management will not be responsible for refunding any Ticket, rescheduling the Event or reimburse any Ticket Holder for any losses.

3. Failure to Agree to Terms & Conditions for Ticket Holders

If the Raffle Ticket Holder, Winner, or resulting Ticket Holder fails to agree or follow to the Terms & Conditions as outlined, their Ticket is invalidated, with no right to refund, and may be redistributed at the discretion of Management.

3.1 Amendments to Terms for Ticket Holders

Management reserves the right, at any moment before, during or after the Raffle, to change these Terms & Conditions. Raffle Ticket Holders will be notified of any change to any updated Terms & Conditions with the option of not agreeing to them without penalty.

3.2 Data Protection for Ticket Holders

4. Severance for Ticket Holders

If one or more of the provisions of these Terms & Conditions is found to be unlawful, invalid or otherwise unenforceable, those provision(s), or part of, shall be deemed severed from the remainder of these Terms & Conditions and shall remain enforceable.

5. Jurisdiction & Governing Law for Ticket Holders

These Terms & Conditions and all disputes, whether contractual or otherwise, arising out of or in connection with them are governed by and shall be construed in accordance with the laws of Scotland and each party submits to the exclusive jurisdiction of the Scottish courts.
